TERMS AND CONDITIONS – Refer a Friend – Fieldays

• Participation in the Scheme is deemed to be acceptance of these terms and conditions.
• Only purchasers of a property from Du Val Group NZ Limited and its related entities (“Du Val”) are eligible to participate in this Scheme (“Eligible Participants”).
• The Scheme commences at on 1 July 2022 and expires at midnight on 30 June 2024 (“Term”). Any referrals made before or after expiry of the Term will not be eligible to participate in the Scheme. Du Val reserves the right to vary or withdraw any and all elements of this offer at any time without notice.
• A valid referral is a referral of a purchaser made by an Eligible Participant during the Term of the Scheme that results in an unconditional Agreement for Sale and Purchase of a Du Val property within the Term (“Valid Referral”).
• For a Valid Referral to exist the purchaser must note you (in writing) as the person who referred them prior to entering into an Agreement for Sale and Purchase with Du Val.
• If you make a Valid Referral, you will be entitled to receive either a Countdown Gift Card or a BP Gift Card (at your choice (subject to availability) to the total value of five hundred New Zealand dollars ($500) (“Referral Gift”).
• If Du Val is (for whatever reason) unable to procure the Referral Gift, you will receive a substitute gift of commensurate value subject to these same terms and conditions.
• You will not be eligible to receive the Referral Gift under this Scheme if the referred purchaser is already registered with Du Val or has already made direct contact with Du Val as at the date of the referral.
• If a purchaser is referred to Du Val by more than one person, only the first person to refer that purchaser to Du Val will be eligible for a Referral Gift under this Scheme.
• Only one Referral Gift shall be given per purchaser. If a purchaser purchases more than one property from Du Val only one Referral Gift shall be given.
• Du Val makes no representations or warranties as to the quality, suitability or merchantability of the Referral Gift.
• Du Val is not responsible to replace any Referral Gift which expires.
• The Referral Gifts are subject to terms and conditions from the individual providers. Du Val takes not responsibility for the terms and conditions of the individual providers.
• The referred purchaser must have consented to having their personal information being provided to Du Val prior to being referred. You indemnify Du Val for any claim arising out of your failure to procure such consent. Du Val will comply with the Privacy Act 2020 in its handling and storage of such personal information.
• To the extent permitted by law, Du Val is not liable for any loss or damage whatsoever which is suffered (including but not limited to, direct or consequential loss) or for any personal injury suffered or sustained in connection with entry into the Scheme or acceptance of the Referral Gift.Du Val may be contacted at [email protected]
